The High Level Committee constituted by the Government of India to review the institutionalisation of arbitration mechanisms in India, in collaboration with EBC, organised a one-day Workshop on Bilateral Investment Treaties - Treatment Standards and Other Issues on 22 April 2017.
The primary objective behind the Workshop was to get the views of experts in investment law and investment treaty arbitration on India's position in relation to its bilateral investment treaties and in the revised 2015 Model Bilateral Investment Treaty, on the following issues: (a) definition of "investment"; (b) fair and equitable treatment; (c) expropriation; and (d) dispute resolution under bilateral investment treaties. For this purpose, the Workshop brought together leading academics and practitioners in investment law and investment treaty arbitration, both Indian and overseas.
The Workshop was well attended by Committee members, lawyers and academics. It is hoped that the Workshop will assist the Committee in making suitable recommendations to the Government of India as part of its final report.
